Terms of Service

The Service prepares photographs and listing text for collectible items. You upload photographs; the Service removes the background, places each item on a square canvas at a consistent size, allows you to group the photographs of a single physical piece, applies descriptive file names, and exports the results as image files and a spreadsheet. Where you request it, the Service also identifies an item from its photographs and drafts listing text for it.

The Service does not appraise, authenticate, grade or value any item, and it does not list any item for sale on your behalf. Any grade, catalog reference, measurement or estimated price it produces is a draft for you to verify.

You must be at least 18 years old to use the Service. You are responsible for all activity that occurs under your account.

Access is by emailed sign-in link or by Google sign-in, so you must retain control of the email address registered to the account. Notify us at hello@thecoinhq.com promptly if you believe another person has obtained access.

You retain all rights you hold in the photographs you upload and in the images and text the Service produces from them. We claim no ownership of either.

You grant us a limited licence to store, copy, transmit and process your photographs and listing text solely to the extent necessary to operate the Service for you. That licence ends when you delete the material or close your account.

We will not use your photographs or listing text to train any model, and we will not publish, sell or license them. Our providers and their obligations are listed in our Privacy Policy.

You represent that you hold the rights necessary to upload the material you upload, and that doing so does not infringe the rights of any third party.

You must not:

• upload material that is unlawful, or that you do not have the right to use;
• use the Service to misrepresent an item to a buyer;
• attempt to access another customer's account, files or data;
• resell, sublicense or rebrand the Service as your own; or
• access the Service by automated means in a manner that degrades it for others.

We may suspend or terminate an account that breaches this section, as set out in section 11.

Current prices and allowances are set out on the pricing page. Usage is metered in credits. An item is one physical piece, however many photographs you took of it, and is charged once, at the point you first export it. Exporting the same item again is not charged again. Identification and research are charged separately, at the rates shown on the button before you press it.

Card payment is not currently enabled. While that remains the case, any paid arrangement is agreed directly by email and nothing renews automatically. We will give you notice before card payment applies to your account.

We may change our prices. A change does not affect a period you have already paid for. Refunds and cancellation are governed by our Refund Policy, which forms part of these Terms.

We do not warrant that the Service will be available without interruption or free from error.

Image processing currently runs on hardware we operate rather than in an always-on data center. Uploads may therefore be queued and processed later rather than immediately. Queued files are stored safely and are processed in turn. We do not offer a guaranteed turnaround time. If your use of the Service depends on one, contact us before you rely on it.

Background removal, identification and research are automated and imperfect. The Service flags images and findings that appear questionable, but that check is advisory: it will both miss defects and raise false alarms. A flagged image may be entirely satisfactory, and an unflagged image may not be.

You are responsible for reviewing every image, and every statement of fact in a draft, before you use it, and for everything you publish or represent about an item in a listing of your own.

We take reasonable care of your files, but the Service is not a backup service. Retain your original photographs in a location you control, and use the export function to keep copies of your finished images and listing text.

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement.

To the fullest extent permitted by law, neither Signal Grove Digital nor its owners, officers, employees, contractors or suppliers will be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, loss of sales, or loss of or damage to data, however caused.

Our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months preceding the claim, or one hundred United States dollars (US$100).

Some jurisdictions do not permit certain exclusions or limitations of liability. Where that is so, the exclusions and limitations in this section apply to you only to the extent permitted in your jurisdiction.

You may stop using the Service and request closure of your account at any time. Export anything you wish to keep first. On closure we delete your photographs, batches and items within 30 days, subject to the retention periods set out in our Privacy Policy.

We may suspend or close an account that breaches these Terms, or where we are required to do so by law. If we close your account other than for breach, we will refund any unused prepaid amount.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. The state and federal courts located in that state have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

These Terms, together with the Privacy Policy and the Refund Policy, are the entire agreement between you and us in relation to the Service. If any provision is held unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.

We may update these Terms. Where a change materially affects you, we will email you before it takes effect, and your continued use of the Service after that date constitutes acceptance. The date at the top of this page shows when it was last revised.
